Regulations Enabling the Use of Digital Wallets for the Payment of Wages and Other Labor-Related Obligations
On February 6, 2026, the Regulations to Law No. 32413 enabling the use of digital wallets to receive the payment of wages and other labor-related obligations were published, approved by Supreme Decree No. 011-2026-EF (the “Regulations”).
In line with the provisions of Law No. 32413, the purpose of the Regulations is to ensure that workers may receive payment of their wages and labor-related obligations through digital wallets linked to: (i) savings accounts provided by entities of the financial system (“FSIs”); or (ii) electronic money accounts provided by Electronic Money Issuing Entities (“EMIEs”), both supervised by the Superintendency of Banking, Insurance and Private Pension Funds (“SBS”), at the worker’s free and informed choice.
The key highlights of the Regulations are as follows:
- Companies that administer savings accounts and electronic money accounts linked to digital wallets must comply with SBS regulations on authorization, risk management, cybersecurity and information security, business continuity, market conduct, and the processing of personal data.
- These companies must provide workers with clear and timely information on the terms and conditions governing the use of both the account into which payments are received and the digital wallet, including any limitations, liabilities, and security measures.
- The digital wallet must be authorized by the Central Reserve Bank of Peru (“BCRP”) to offer interoperable payment services, in accordance with the Regulation on Interoperability of Payment Services (BCRP Circular No. 0024-2022-BCRP, as amended) and other applicable BCRP regulations.
- The SBS shall establish the operational limits applicable to digital wallets used for the payment of wages and other labor-related obligations, with the aim of ensuring full and timely payment, transaction security, financial inclusion, and the prevention of money laundering and terrorism financing activities.
- At the commencement of the employment relationship, the worker shall notify the employer, within ten (10) business days from the start of the relationship, of the name of the FSI or EMIE chosen to receive payment through a digital wallet. If the worker does not communicate such choice, the employer must make the payment through an FSI or EMIE located in the place where the workplace is situated.
- During the employment relationship, workers may opt to receive payment through a digital wallet by notifying the employer of the information necessary to effect the payment (including the chosen FSI or EMIE) within the first ten (10) business days of the month corresponding to the payment of remuneration.
